Introduction
This Site is provided by the Luzerne County Transportation Authority (“LCTA”), chartered as a local government unit exercising the public powers of the Commonwealth of Pennsylvania as a municipal authority and instrumentality thereof, with offices located at 315 Northampton Street, Kingston PA 18704, as a service to our customers. Please review the following basic rules that govern your use (“Terms of Use”) of the LCTA site (the "Agreement"). Please note that your use of the LCTA site, including the http://www.lctabus.net web store site (collectively, the "Site") constitutes your unconditional agreement to follow and be bound by these Terms of Use. Although you may "bookmark" a particular portion of this Site and thereby bypass this Agreement, your use of this Site still binds you to these Terms of Use. LCTA reserves the right to update or modify these Terms of Use at any time without prior notice to you. For this reason, we encourage you to review these Terms of Use whenever you use this Site.

Use of this Site
By accepting these Terms of Use through your use of the Site, you certify that you are 18 years of age or older. If you are under the age of 18 but at least 13 years of age you may use this Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. LCTA does not intentionally collect personally identifiable information about children under the age of 13. Children under the age of 13 may not use this Site other than for browsing, and parents or legal guardians may not agree to these Terms of Use on their behalf. If you are a parent or legal guardian agreeing to these Terms of Use for the benefit of a child between the ages of 13 and 18, be advised that you are fully responsible for his or her use of this Site, including all financial charges and legal liability that he or she may incur. If you do not agree to (or cannot comply with) any of these terms and conditions, do not use this Site. All billing and registration information provided must be truthful and accurate. Providing any untruthful or inaccurate information may constitute a breach of these Terms of Use. By confirming your purchase at the end of the checkout process, you agree to accept and pay for the item(s) requested.

The http://www.lctabus.net web store and LCTA grant you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of LCTA. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; any use of data mining, robots or similar data gathering and extraction tools. This Site or any portion may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express consent of LCTA. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information of LCTA without express consent of LCTA. Any unauthorized use terminates the permission or license granted. You are granted a limited, revocable, and nonexclusive right to create a hyperlink of this Site so long as the link does not portray http://www.lctabus.net web store, http://www.LCTAbus.com, LCTA Shared Ride or any arm of LCTA, their products or services in a false, misleading, or otherwise offensive matter. You may not use any LCTA logo or other proprietary graphic or trademark as part of the link without express written permission.

Violations of system or network security may result in civil or criminal liability. LCTA will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of this Site or any activity being conducted on this Site. You agree, further, not to use or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Site other than the search engine and search agents available from LCTA on this Site and other than generally available third party web browsers (e.g., Mozilla® Firefox® Netscape® Navigator™, Microsoft® Internet Explorer™).

You may register an account on this Site (including setting up a user identification “user id” and password). You are entirely responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. Please note that there may be certain orders that LCTA is unable to accept and must cancel. LCTA reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our fiscal and/or IT departments. LCTA may also require additional verifications or information before accepting any order. LCTA will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card has been charged, LCTA will issue a credit to your credit card in the amount of the charge.

Once the http://www.lctabus.net web shop has accepted your order, your credit card will be charged. The payment terms are contractual obligation between you and your credit card company. In the event of fraudulent or disputed charges, you must contact your credit card provider and deal with them under the terms and provisions of your contract with them, not LCTA. If a credit card is stolen the maximum liability by law is $50. However, you need to contact your credit card provider under the terms and conditions of your agreement with them to facilitate the dispute process.

Pricing Information
While LCTA strives to provide accurate product and pricing information, pricing or typographical errors may occur. LCTA cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, LCTA shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. In the event that an item is priced incorrectly, LCTA may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Prices and availability are subject to change without notice.

Quantity Limits and Dealer Sales
LCTA reserves the right, at our sole discretion, to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same LCTA account, the same credit card, contracted service, and also to orders that use the same billing and/or shipping address. LCTA will provide notification to the customer should such limits be applied. LCTA also reserves the right, at our sole discretion, to prohibit sales to dealers. It is illegal to sell LCTA fare instruments/media unless under specific contract with LCTA to do so.

Upon any termination of the Agreement by either you or LCTA, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the Terms of Use or otherwise. Information Collection and Use
LCTA does not knowingly collect personally identifiable information from children under the age of 13 nor does it wish to collect any such information. Federal law requires website operators who wish to obtain information from children under the age of thirteen to get parental consent. However, LCTA, in its effort to protect the privacy rights of children, will not knowingly collect personally identifiable information from children under the age of 13 even in the event that parental consent is obtained. If we determine that a child under the age of 13 has provided personally identifiable information in violation of this policy, we will delete that information as soon as practicable.

What types and categories of information can be gathered?
LCTA can gather two types of information about you. The first is “Personally Identifiable Information”. This is defined as any information that could be reasonably used to identify you, including but not limited to your name, shipping address, billing address, phone number and e-mail address or any combination of that information. The second type of information is “Tracking Information”. Tracking information is defined as the information recorded as users navigate throughout the website. Tracking information is not used to identify but rather statistically to rate pages and track preferences of visitors.

LCTA may also gather Personally Identifiable Information about you regarding your purchase. When you order a pass or ticket through our site, we will collect the following information to properly complete your order: your name, address, telephone number, e-mail address, shipping information and credit card information. We use a reputable company to verify your credit card information before billing your account. We will also share your shipping information with the delivery service (U.S. Postal Service). Your order is processed through a secured server using advanced forms of encryption software.

If you do not supply personal information for one of the purposes listed above, we make no attempt to identify you. LCTA only tracks aggregate usage data to help us improve site content and organization.

Credit card information is not stored on the My Account – Profile but, instead, is stored on a per transaction basis. Credit card information is transmitted in encrypted manner and you will only see the last four digits of the credit card number on the transaction receipt you receive. The credit card information is will not be retained on LCTA’s database after the transaction is complete.

How is the information gathered?
Information is gathered through the use of website browser “cookies”.  A website cookie is a parcel of text sent by a server to a web browser and then sent back unchanged by the browser each time it accesses the server. They are used for authenticating, tracking, and maintaining specific information about users.

There are “session-based” cookies that are used for tracking purposes. Session-based cookies are automatically disabled or deleted once the visitor closes his or her browser software at the end of the session. There are also “persistent” cookies. Persistent cookies remain stored on the registered user’s computer system until he or she deletes them.

Visitors may disable cookies through most standard browsers. Remember the persistent cookies are solely to simplify your experience. The session-based cookies are used solely for tracking purposes so that we can bring you a more enjoyable online experience.  Cookies don't identify you personally, but rather identify your computer when you visit our site. It can be used to identify your session at a particular web site. If you are concerned about privacy, you may set up your browser not to accept cookies, or you can delete them from your hard drive once you leave the site. Turning off cookies may affect your ability to use this website.

How is information used once gathered?
Personally Identifiable Information is stored on a database and is used solely for the purposes of LCTA. It may be used for LCTA’s marketing and promotions through e-mail. It will not be sold, rented, swapped or otherwise shared with third parties. There are two exceptions to this Privacy Policy. (1) LCTA may release Personally Identifiable Information in connection with (a) legal proceedings or contemplated legal proceedings that directly relate to such information; or (b) in response to a subpoena or court specifically requesting such information; and (2) in cases involving threat of imminent harm to you or others, LCTA may release such information to prevent or mitigate the threat.

In any such case, LCTA will limit the scope of the disclosure and restrict the disclosures only to the appropriate authorities. We will limit such disclosure to only that Personally Identifiable Information that is reasonably required to fulfill the purpose of the disclosure. Unless instructed by the court or other proper authority, we will take reasonable efforts to (a) notify you of the disclosure or request for disclosure, and (b) provide you with this notice as far in advance of the disclosure as is reasonably practicable. If LCTA acts in proper accordance with the procedures in this section, it cannot be held responsible for the proper recipient’s later use of that information.

How does LCTA protect your Personally Identifiable Information?
All information is stored within a database controlled and accessible only to LCTA and its specifically authorized contractors. Even with effective measures of security implemented by LCTA, no security system is impenetrable. LCTA cannot guarantee the complete security of its system, nor can LCTA guarantee that information supplied would not be intercepted while being transmitted over the Internet. If you do not want LCTA to know any particular piece of information about you, then do not include it either in e-mail or do not post it to the website.

LCTA uses the industry-standard Secure Sockets Layer (“SSL”) to guarantee encryption during the online purchase process. This is to protect the transmission of credit card and other Personally Identifiable Information relevant to the purchase. LCTA will store Personally Identifiable Information regarding your registration information, but not your credit card, for your future use. No security is perfect, so if you feel uncomfortable providing your credit card or other Personally Identifiable Information over the Internet, do not do so. In order to purchase, you must use a browser that is SSL-enabled (e.g. Microsoft® Internet Explorer™, Mozilla® Firefox®, Apple® Safari™). A secured purchase is signified by the term “https:/” in the browser. A lock will appear in the corner of the bar of the browser illustrating that a secured transaction is taking place.  For customers who do not wish to give out credit card information over the Internet, LCTA has physical locations to purchase tickets at the Wilkes-Barre City Intermodal Center and LCTA Administrative Headquarters, 315 Northampton St., Kingston, PA 18704.

Sending E-Mail

If you send an e-mail that includes personal information, we use the information only to respond to your e-mail. However, we may forward your e-mail to another agency if we believe that agency is better prepared to answer your question. We do not use information received in e-mails to create personal profiles.
